General Terms and Conditions of Sale - Resort

Terms used herein with a capital letter without having been previously defined have the meaning given to them below :

« Customer " means a natural person, major premise, acting for his personal needs and having full legal capacity to commit himself hereunder.

« Establishment " refers to the Villa Occitana hotel park, operated by SASU Valeurs Occitanes

« Benefit(s) " means any room reservation service made by the Customer on the Villa Occitana website, and/or any other service offered within the Establishment.

« Villa Occitana website " refers to the website dedicated to the Establishment, accessible at the following address: https://www.villaoccitana.com

« Booking confirmation " means the document summarizing the details of the reservation made by the Customer, sent by the Website or the Establishment to the Customer.

Booking a room :
When booking, the Customer must provide a certain number of mandatory data, including certain personal data necessary for the processing of the reservation by Villa Occitana, who reserves the right to refuse any reservation in the absence of these data or due to their erroneous nature. The Customer must also indicate the number of persons benefiting from the Services, and their age, any minor over the age of 12 years being considered an adult.

No discount will be granted in case of delayed arrival or early departure.
No reservation can be made for a specific room number.
Flat-rate guarantee per room made by credit card imprint: 500 €
No reservation can be transferred to a third party. Application fees : included in the room.

Confirmation of a reservation :
The allocation of the room will only become effective after receipt of a booking confirmation e-mail. Any incomplete file can in no case be the subject of a firm and definitive reservation. No date change or option deletion is possible unless 30 days before your arrival.

The duration of the contract between the Customer and the Establishment corresponds to the duration of the Accommodation Service provided for in the reservation.

Payment of the deposit :
Depending on the formula or booking platform chosen, you will be asked to pay part or all of the reservation. This payment is mandatory in order to guarantee the stay, otherwise the option will be cancelled; unless this is clearly stated at the time of booking, this deposit or full payment will not be refundable.

Arrival – Departure :
Arrivals are from 16:00 until 20:00. For all arrivals after these times, please inform the reception when booking. We accept late arrivals until 22:30. Upon check-out the room must be vacated before 11:00. For any departure after 11:00, the day started will be due.

Delay :
After 20:00 on the day of arrival provided for in your contract and in the absence of a message from the Customer, the room can be re-rented. The deposit and the administrative fees will not be refunded under any circumstances.

Your arrival :
The Customer is required to park in front of the property and present himself at the reception with the Booking Confirmation, accompanied by a valid piece of identification. The balance of the stay and taxes must have been fully paid. No payment period will be granted.

Cancellation :
Reservations with prepayment are not subject to change and/or cancellation. Sums paid in advance constituting a deposit, they will not be subject to any refund, what will be indicated in the conditions of sale of the tariff brought to the attention of the Customer and accepted by him.

Price of Services :
The price of the Services is indicated on the Villa Occitana Website before booking on the description sheet of the offer, as well as during the booking process. Rates shown are per room, for the number of people indicated, depending on the selected period, and include only the Services strictly mentioned in the reservation.
The price of each Service is indicated all taxes included (Ttc), excluding tourist tax, and details the amount of VAT applicable to the Service.
The euro is the commercial currency of the reservation, the payment must therefore imperatively be made in this currency. The prices mentioned on the Site are subject to change at any time by Villa Occitana, without prior notice or notice. Only the price indicated in the booking confirmation is contractual.

Stay and Deposits :
A bank guarantee of 500 € is automatic taken by bank loan for any rental. This deposit may be debited by the Establishment in case of damage, deterioration or act of vandalism observed by the Customer or that of his servants or persons in his care, during the occupancy of the premises. In case of non-compliance with the rules of the resort ( respect for the neighbourhood, nocturnal noise, grouping of several rooms into one, smoking in public places, etc…) the deposit will also be levied to cover the commercial offers offered to victim customers and to cover the damage caused to our establishment.
Theft or loss of the following items will also be deducted from the deposit :
– Loss of key : 50,00€
– Smoking, electronic cigarette : 500,00€
– Dressing gown : 80,00
– Towel : 30,00
– Hairdryer : 60,00
– Shower gel, shampoo, condition : 22,00/pot
– Or any other missing or damaged object

Besides, if the damage exceeds the amount of the deposit, the Customer will be required to reimburse in full the damage caused by his actions, the Institution having any option and being able to take any useful action to obtain compensation for the damage suffered.
Villa Occitana provides Guests with Wi-Fi Internet access throughout the property.
The Customer undertakes to ensure that the computer resources made available are not used for fraudulent or illegal purposes, and in particular to commit any act of infringement of third party rights and/or illegal downloading of works protected by copyright punishable by Article L.335-2 of the Intellectual Property Code.

Personal data :
In application of Law n°2018 – 493 of the 20 June 2018 on the protection of personal data and the General Data Protection Regulation No. 2016/679 (GDPR), the Customer is informed that the information provided during the reservation has been subject to the processing of personal data for the purposes of managing reservations and Customers, billing and payment needs,
as well as for commercial prospecting purposes.

Assurance security :
It is the Customer's responsibility to be up to date with his contributions concerning their civil liability.
The management declines all responsibility in case of theft, loss and degradation due to bad weather or accidents that would occur inside the Establishment. Vehicles parked in the car park, although secure (located inside and outside the establishment) are also not under the responsibility of the hotel fleet.

Tobacco / Electronic cigarettes :
Accommodations are strictly non-smoking : if an odor is detected after the Customer's stay, the sum of € 500.00 will be debited from the deposit. Electronic cigarettes are banned. In the park, Customers are requested to use the ashtrays made available to them.

Barbecues :
Except in the restaurant, charcoal barbecues, gas or electric are prohibited.

Animals :
Pets are not allowed in the Property.

Groups :
Our concept is mainly focused on couples, no group will be accepted without the prior agreement of the management. We reserve the right to cancel any stay before or during the stay for any group that has not previously requested permission to stay. We also reserve the right to cancel the reservation during the stay to any group that does not respect the rules of the rules of the resort (grouping in a room, nocturnal noise, etc.) and to levy the deposit of 500 euros in order to compensate for the damage caused.

Circulation – noise :

Speed is limited to 10km/h. Priority for pedestrians and cyclists throughout the park. Parking is prohibited on driveways and access roads, it must be performed at the specified locations. The gate is closed from 23:00 to 07:00 in the morning, period during which all traffic is prohibited. 

In case of late arrival parking is provided on the parking outside the hotel. LPG vehicles are not allowed on the premises of the establishment. Any use of sound devices must not harm its vicinity. Noise must not disturb the tranquility of Customers. It is strictly forbidden to honk your horn.

Swimming pool regulations :
Access to the spa is forbidden to minors. The aquatic area is strictly reserved for hotel guests. Minor children must be accompanied by an adult in the pool. Shower is mandatory. People who do not respect the instructions will be expelled from the pool, of the hotel if they refuse to comply with hygiene rules.
Swim shorts are strictly prohibited in the pool. Buoys are prohibited.

Any Customer is required to comply with the provisions of the internal regulations. Anyone staying at the resort must be mentioned at the time of booking. Management reserves the right to expel without notice, nor reimbursement of persons who fail to comply with the rules of procedure, or who have not declared all the occupants or given false information about the occupants of the plot or rental. Personal data can be updated or deleted upon request by e-mail, the GDPR file can be consulted on receipt on request.

Gift vouchers :
Gift vouchers can be used exclusively for the service mentioned. They are activated by the presence of the hallmark or the signature of the establishment. They are valid 1 year from receipt of payment and usable outside increased periods (School holidays, Holidays, Special periods, High season from June to September,…). They are not exchangeable, non-refundable. Present your gift voucher at checkout, It will be deducted from the price of the services delivered by the establishment.  These conditions are applicable to all sales concluded with SKYBAR

As a result,, The Customer acknowledges having read these General Terms and Conditions of Sale and undertakes to comply with them.

These conditions of sale are subject to change at any time, and the applicable conditions will be those in force on the date the reservation is made.

Any confirmation of reservations implies your full and complete acceptance of these general conditions of sale., without exception or reservation. 

The booking confirmation will be worth signature and acceptance of these conditions.


ARTICLE 1- PRICES AND PRODUCTS

The prices indicated are in euros, Service included, and take into account the VAT applicable on the day of booking, they extend per person. The VAT rates in force will be applied, either 10% for food and soft drinks, and 20% for all alcoholic beverages and services.
 Any change in the applicable rate, or any modification, or introduction of new legal taxes introduced by the competent authorities, will be automatically reflected in the prices indicated on the invoice date.

It is specified that the restoration, and drinks not consumed as part of a package, may not give rise to a price reduction, whatever it is. It is up to the SKYBAR customer to appreciate before booking, if the price suits him (Display at reception, website, Request by SMS or email).
No dispute concerning the price of the service, cannot be taken into consideration at a later date.

The photographs and illustrations presented on the site are not contractual.


ARTICLE 2- RESERVATIONS AND MEANS OF PAYMENT

Reservations are made on the sitewww.villaoccitana.com or by e-mail : [email protected].

The SKYBAR being an ancillary service of the resort VILLA OCCITANA and its concept of quietude, the same conditions apply, Access is therefore reserved for people over 12 Years. 

In accordance with the provisions of Article L. 3342-1 of the Public Health Code, the sale of alcohol to minors under the age of 18 years is prohibited. Consequently, the purchase of any alcohol-based product at the time of the Sale, Minors under the age of the age are strictly prohibited 18 Years. An identity document may be requested from the Customer when ordering.

Payment for all services will be made to the restaurant.
 We reserve the right to request a deposit of 50% for any reservation greater than 10 persons. Bookings of more than 10 people must be subject to validation by the restaurant manager beforehand, by email to : [email protected]

Bookings regardless of their origin will be payable in euros only.

SKYBAR accepts Visa credit cards as well as cash payments, Restaurant menu, or holiday voucher.

The customer accepts that the elements related to his reservation may be used for statistical analysis by SKYBAR.


ARTICLE 3- CHANGES AND CANCELLATIONS

Any changes to the booking (Number of covers, schedule, ...) must be made to the SKYBAR by sms or email at least 24 hours before the scheduled time of the service. The customer undertakes to notify the SKYBAR at least 4 hours before scheduled arrival, if the latter cannot honour his reservation.

If the customer warns of his cancellation less than 4 hours before the scheduled arrival or if the customer does not show up when booking (no-show),THE SKYBAR reserves the right to charge the amount of the bank imprint.


ARTICLE 4- BANK FOOTPRINT 

The customer accepts when booking that SKYBAR requires the customer's bank details by taking a bank imprint and that the customer reserves the right to keep the customer's bank imprint in case of reservation not honored by the customer or late cancellation by the customer, i.e. less than 4 hours before the scheduled time of the reservation in accordance with article L221-28, 12 of the Consumer Code, The user may not exercise his right of withdrawal for the provision of catering services and leisure activities that must be provided on a specific date or period.

This imprint will not be debited except in case of late cancellation or non-honored reservation.

The customer must provide a payment card whose validity period is subsequent to the reservation or undertakes to modify the information transmitted during the reservation in case of a card that has become invalid. In that case, The reservation will be put on hold until the user provides valid bank details. An email will be sent by the booking platform to inform the customer of the invalidated of his means of payment and will invite him to make the necessary changes. 

This bank imprint will in no case be used as a prepayment by SKYBAR for the service booked by the user. The final objective of taking the bank imprint is to guarantee the arrival of the customer and his possible guests. No amount is charged to the user at the time of making the reservation.


ARTICLE 5- MODIFICATION OF THE SERVICE AND FORCE MAJEURE

Force majeure means any event external to the parties that is both unforeseeable and insurmountable., which prevents the customer in the realization of his reservation, to perform all or part of the obligations provided for in the contract. This will be the case, in particular, with regard to transport strikes., hotel staff, government or public riots, or total or partial strikes hindering the smooth running of the restaurant or that of one of its suppliers, subcontractor, or carriers, as well as the interruption of energy supply, of raw materials.

SKYBAR reserves the right to modify or suspend the service or some of its features without notification of repair., maintenance, improvement or other technical reason and for any reason whatsoever without notice and without obligation to justify its act.


ARTICLE 6- INFORMATION TECHNOLOGY AND FREEDOM

The SKYBAR offers wifi internet access. The user customer undertakes that the computer resources made available to him are in no way used for reproduction purposes, Representation, making available or communicating to the public works or subject-matter protected by copyright, by a neighbouring right such as texts, images photographs, Audiovisual musical works, Software and video games, without the authorization of the holders of the rights provided for in Books I and II of the Intellectual Property Code when such authorization is required.

The establishment has a video surveillance system in the common areas of the building as well as the car park.


ARTICLE 7- IMAGE RIGHTS

During your stay at the restaurant, We may ask for your consent, to be photographed. Once you have given your consent, We will be able to use the photographs, for any public screening, advertising, press, Social Media, website, Electronic publications, Postcards, or decorative objects.  

The SKYBAR expressly refrains from exploiting the photographs that may infringe the privacy or reputation of the person(s).(s) photographed(are), nor to use the photographs subject to the said authorization on any pornographic medium, racist, xenophobic or other harmful exploitation. The restaurant will be available to the person(s)(s) Photographed(s) proof of each publication, Available on request.

By giving permission, the person(s)(s) photographed(are) Confirms(Nt) his/her authorisation is given knowingly without consideration. The model(s)(s)  manifest(Nt) as well as its interest and support for the work of the resort VILLA OCCITANA and restaurant SKYBAR. They will not be able to claim any remuneration because of the uses of the images made.


ARTICLE 8- CLAIM AND APPLICABLE LAW

Any complaint must be sent to SKYBAR by registered letter A / R, and this within a period of 15 days following the departure of the stay that is the subject of the said claim. After this period, No claim can be taken into account. 

These General Terms and Conditions of Sale are governed by French law..  This is the case for both substantive and formal rules.. Disputes that cannot be resolved amicably, will fall under the jurisdiction of travel tourism mediation, and/or French courts.
